Terms of Service

Effective Date: February 4, 2026

These Terms of Service ("Terms") govern your access to and use of the StormRecord™ mobile application (the "App"), the StormRecord website at stormrecord.com (the "Website"), and related services (collectively, the "Service"), operated by StormRecord™ ("StormRecord," "we," "us," or "our").

By creating an account, making a purchase, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

StormRecord is a historical weather reporting platform that generates Historical Weather Reports ("Reports") by aggregating publicly available historical weather data from archived public sources, including the National Weather Service (NWS), the National Oceanic and Atmospheric Administration (NOAA), the NCEI Storm Events Database, and Visual Crossing.

StormRecord provides weather data aggregation, not expert testimony. Reports are compiled from archived NOAA and National Weather Service observation data and are intended to support — not replace — professional assessments or expert analysis. StormRecord does not interpret, analyze, or opine on causation, liability, or the outcome of any claim, case, or dispute.

2. Nature of Reports — Important Disclaimers

Please read this section carefully, as it defines what StormRecord Reports are and are not.

2.1 What Reports Are

  • An aggregated record of historical weather observations from publicly available government data sources
  • A timestamped snapshot of weather data available at the time of generation
  • Supporting documentation intended to accompany documentation needs, contractor records, or other legitimate purposes
  • Generated automatically based on the address and date you provide

2.2 What Reports Are Not

  • Expert testimony or a forensic weather analysis
  • An engineering inspection or structural damage assessment
  • A determination of insurance coverage, causation, or policy applicability
  • A guarantee of any outcome related to the use of reports
  • Government-issued records or certifications (such as NCEI stamped documents)

2.3 Data Accuracy

StormRecord does not alter, interpolate, or estimate weather observations beyond values provided by its archived public sources. Weather data is retrieved from the nearest available weather station to the address you provide. The distance between the station and your property, as well as localized weather variations, may affect how precisely the data reflects conditions at your specific location. Station identity and distance are disclosed in every Report for transparency.

You are responsible for evaluating the relevance and applicability of any data contained in a Report in light of your specific circumstances.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

4. Account Registration

To purchase Reports through the iOS app, you must create an account using a valid email address or through Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access.

To purchase Reports through the Website, no account is required. You will provide an email address during checkout for receipt and communication purposes.

5. Purchases and Payments

5.1 Pricing

Historical Weather Reports are available for a one-time purchase fee as displayed in the App or on the Website at the time of purchase. Prices are listed in U.S. dollars and are subject to change. The price in effect at the time you complete a purchase will apply to that transaction.

5.2 Payment Processing

Purchases made through the iOS app are processed through Apple's App Store. Purchases made through the Website are processed by Stripe. By making a purchase, you also agree to the payment terms of the applicable platform. StormRecord does not directly process or store payment card information.

5.3 Refund Policy

Because Reports are generated instantly upon purchase using real-time data retrieval, all sales are final. We do not offer refunds for completed Reports.

If you experience a technical issue that prevents your Report from being generated or delivered, please contact us and we will work to resolve the issue or, at our discretion, issue a replacement Report or refund.

Refund requests for purchases made through the Apple App Store must be directed to Apple in accordance with their refund policies. For web purchases, contact support@stormrecord.com with your Stripe receipt details.

Nothing in this section limits StormRecord's ability to address obvious system errors or duplicate charges in good faith.

5.4 Accessing Purchased Reports

For iOS app users: If you reinstall the App or switch devices, you may restore your previous purchases through the "Restore Previous Purchase" option available in the App.

For web users: Report download links are available on the confirmation page immediately after purchase. Save your PDF when it is ready. If you need a copy re-sent, contact support@stormrecord.com with your receipt details.

6. Intellectual Property

6.1 Our Property

The Service, including the App, the Website, their design, code, report templates, branding, and the StormRecord™ name and trademark, is owned by StormRecord and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

6.2 Your Reports

Reports you purchase are licensed to you for your personal or business use. You may share, print, or submit Reports to insurance companies, adjusters, contractors, attorneys, or other parties as needed to support your claims or documentation needs. You may not resell Reports or use them for commercial redistribution.

6.3 Weather Data

The underlying weather data contained in Reports originates from public government sources (NOAA, NWS) and third-party data providers (Visual Crossing). StormRecord claims no ownership over the raw weather data itself. Our value lies in the aggregation, formatting, analysis, and presentation of that data.

7. Acceptable Use

You agree not to use the Service to:

  • Submit false, fabricated, or misleading information in connection with a Report
  • Use Reports to support fraudulent claims or misrepresent weather conditions
  • Attempt to access, tamper with, or modify weather data or report content
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the App or Website
  • Use automated tools to scrape, harvest, or extract data from the Service

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Limitation of Liability

This section limits our legal liability. Please read it carefully.

To the maximum extent permitted by applicable law:

StormRecord is not responsible for the outcome of any insurance claim, legal dispute, contractor dispute, arbitration, mediation, or other proceeding in which a Report is used. Reports are informational tools that aggregate publicly available data. The interpretation of that data and any decisions made based on it are solely your responsibility.

StormRecord, its operators, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid to StormRecord in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Weather data in Reports will be complete, accurate for your specific micro-location, or suitable for any particular use
  • Reports will be accepted by any insurance company, adjuster, court, or other party
  • The use of a Report will result in a favorable outcome for any claim or dispute

10. Indemnification

You agree to indemnify and hold harmless StormRecord, its operators, and its service providers from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your submission of false or misleading information.

11. Account Deletion

iOS app users may delete their account at any time through the Account Settings screen in the App or by contacting us. Web-only users may request deletion of their data by contacting us at the email address below. Upon deletion, your data will be removed in accordance with our Privacy Policy. Previously downloaded Reports will remain on your device unless you delete them.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. The arbitration shall take place in Massachusetts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Material changes will be communicated through the App, via email, or by posting the updated Terms on our Website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StormRecord regarding the Service and supersede any prior agreements.
